REFUND CLAIM ON PARTNERSHIP FEES FOR SKEWED CONTRACT
We are a company based in Kenya, that entered into a partnership with a UK based energy company in July 2021 to become a licensed reseller of their products and services in Kenya. This agreement was on a Non-exclusive basis. We paid a sum of US$ 24,500 which is 50% of the total partnership fees that we were required to pay. We received demo kits worth GBP 922.00 and GBP 612.00 respectively on diverse dates in 2021, and a 2.5 hour a day induction training for 5 days. We made a decision to terminate our partnership in January 2023, because we were not benefitting from the partnership. We are now seeking a refund of our partnership fee less any cost that we incurred in terms of both services and products received. The UK company is not willing to refund us and they state that according to our signed contract, their is no provision for refunds. We deem this to be an unfair contract as there is no written breakdown on how the partnership fees are arrived at. Kindly support
