Purchasing goods from China
Dear colleges, I need assistance with a case I came across. A company have ordered a load of Corten steel sheet from a Chinese company and paid €20,000 as a prepayment. Unfortunately, the Chinese seller after receiving the prepayment claimed a higher price due to the rise in global steel prices. At the moment there isn’t such thing as a contract between the buyer company and the seller, only a purchase order signed by both parties. The payment was paid after verification of PI(purchase Invoice), however, the seller has stated only in their email exchanges that the price will be fixed till the end of the agreement. What can be done at this stage? Can you please advise me regarding this matter.

The terms and conditions of the Contract binds both the parties where there is no objections raised over the Terms and conditions of the Agreement by the Parties in the Agreement. Legal remedy can be seeked only and when there is a breach of any terms and conditions stated and agreed by both the Parties. As the case is quiet sensitive, I need to study thr contract thoroughly. I also need to know what legal jurisdiction is the contract based on? Is there arbitration clause provided in the contract Or not! Please provide me more information
