Punitive Damages in default Cases
As a default litigant, the defendant would be unable to argue the facts presented in the complaint. As a result, with the lack of a jury, the plaintiff's damage award is solely up to the presiding judge. How does a plaintiff act to obtain a punitive damage award in a default judgment from a judge?
