Labour Law - Minimum notice period to prevent a breach of contract An individual is hired by company X in South Africa. In the first and second year of the contract, he was provided with a fixed-term contract while the next year, he was granted permanent employment and remained at Company X for 18 months when he chose to resign.
Regarding the notice period, the contract notes:
(i) Less than six (6) months: one (1) weeks’ notice.
(ii) Six (6) months or longer – but less than one (1) year: one (1) calendar months’ notice.
(iii) Longer than three (3) years: three (3) months’ notice.
Which notice period is he required to give to not be in violation of the contract?
