Is it legal for a retailer to modify a product to remove best before dates and batch numbers?
Our company manufactures a trademarked liquid animal feed product and supplies it to retailers in the US, via a distributor. Recently, we have discovered that one of the retailers has been wiping off the best before dates and batch numbers printed on the bottles, claiming that we have never provided these details. I have been informed that they are allowed to wipe these off. Is this legal? How can I make it stop? Moreover, can we force the retailer to stop selling the product once it has expired or ideally close to expiry?
