holding fee
Applied for an apartment and was charged an application fee and asked to pay the security deposit in advance. Ended up not signing a lease and now they're holding my deposit claiming it has a "holding fee". I have written communications that call it a deposit. I need legal help getting it back.

What to do depends on which state law governs the lease. Usually for residential property for leases for one year the security deposit, first month and last months rent is paid upon signing the lease. If you did not sign the lease, the rules governing the holding fee may be in the application's fine print. Typically, a security deposit should only be paid after or contemporaneously with the signing of the lease.
