Historically, has the Categorical Imperative been used to establish “personal judicial precedent”?Has the Categorical Imperative, or something similar, even been used historically to establish something that could perhaps be termed, “Personal Judicial Precedent”? By this, I mean a practice whereby a verdict is issued based on the actions of the defendant and see if she/he was in a situation where the general presumption is reversed, so we must see how the defendant dealt with that particular situation.
