It depends. A breach of employment contract can happen in several ways, including terminating the employee without proper notice, refusing to pay the employee what they're owed or even firing the employee in retaliation for trying to enforce their rights under the contract.
If an employee violates the terms of their employment contract, the employer may be able to sue them for damages. Factors that may influence whether or not an employer can sue for breach of contract include the severity of the violation, how much harm was caused, and whether or not the employee had a warning that breaching the contract would result in consequences.
