Debt recovery in Kenya
My Kenyan colleague signed a consulting contract with an American business person who set up a startup business in Kenya. He was paid a small portion of the fees he earned. The American then closed the business, left Kenya for a job with an American business. My Kenyan colleague has had no luck in collecting the money owed him for services delivered. What is his best recourse?

Hallo, Your colleague's cause of action springs from the consultancy contract s/he signed. S/he also needs to have in hand proof that s/he delivered his/her services to the American businessperson for the debt owed. Get in touch with us at [email protected] for further legal advice.

Hello, We advice that this is a case of breach of contract bordering on money had and received. No advice on debt recovery will be given until you furnish us with the contract agreement which you signed with the American business partner. Kindly read more about our legal services on our website at: www.sk-solicitorsng.com and send us an email to: [email protected] for further legal advisory service. Thanks,

He can institute a suit for recovery of the debt. The suit can be instituted here (in Kenya). Your colleague can get in touch with us for further consultation.

It would be useful to see the contract signed between the parties in order to determine the dispute resolution mechanisms provided and how the violations occurred. Suing the American and enforcing the judgment may be an option however enforcement of the judgment can be problematic because USA is not one of the countries recognized as reciprocating countries under the Foreign Judgments Reciprocal Enforcement Act

You can file a suit for recovery and seek compensation, payment of the remnant fee and damages.
