Asaba nigeira negligence
My name is Debbie Collins, I live in Corpus Christi, Texas, USA October 5, 2021 I fell into a storm drainage system hole at about 5:30 PM I was immediately rushed to the local hospital, which was on strike, and I was not able to be treated at that time. I was brought back to the compound and waited to the next morning, and was taken to a hospital inside of Asaba Nigeria, at which time I had compartment syndrome, broken bones and torn ligaments, and my kneecap was shattered. I had to go emergency surgery due to the compartment syndrome, and they put a plate to stabilize my bones. I caught malaria in the hospital also. I was allowed to leave 15 days later, and I came straight back to the United States by the time I got back to United States, my leg was, so infected that I was told they needed to try and save my life and then my leg I had a 50% chance of losing my life and 90% chance of losing my leg. 15 months later approximately 10 surgeries I am facing in a bump in the amputation at the end of this month, due to the infection that I got due to the dirty plates, and the whole I fell in Asaba Nigeria government has started a stormwater drainage program a few years back like 2018 and they’re having at least 10 people of their citizens have died from falling in those holes but you can’t see them at night on your covered with water and the government has proven and stated they would cover them and they have not been covered. I didn’t see that manhole I did not see it at all and did not realize it was there and when I reached the door to get into a car accidentally step and I went down and I went down so hard I went standing and I had seen it 6 feet down and fell to my side and it has been the worst roller coaster of my life. The worst of all I still live in a wheelchair because of it and now I’m going to lose my leg. Is there a law or a way that I can sue? Whoever it is I need to the city the government of the city? I’m not sure if I selected the correct type of lawyer on the topic, but if I didn’t, please forward it to the correct one because I believe because of the what happened to me the city or the government other city who already knew that this was a hazard should help me I would’ve never sued him if I hadn’t lost my leg I’m going to lose my leg because it’s got to this extent and I feel that it is wrong and I feel that people in Nigeria should also be able to show that they are wrong and doing this to them I want to sue them.

Hi Debbie, first and foremost, I feel so sorry you had to go through this traumatic experience in Delta State. As my colleagues have mentioned here, you can sue for negligence as the hospital owed you a duty care. I can provide you with assistance if you need further legal advice on the action you may institute against the company and/or hospital.

Well from all indications,the construction company as well as the Hospital can be sued for negligence,the Nigerian court will award you damages depending on what your requested.

You can institute an action against the company for negligence and also against the hospital for negligence because if the hospital had treated you well, they should not have put a dirty plate in your leg which caused the said infection. Also, you will need a lawyer who is willing to visit the places you mentioned in Nigeria to ascertain the facts and get more information as to the name of the company that left the manhole uncovered. Thank you

Yes you have the right to sue because of the injury and other inconvenience you have suffered. Apart from the government, the company that dug the hole will be held liable. We need to go and discover more facts so that we can write a Pre-Action Notice to the relevant parties on your behalf. The Pre-Action Notice is a procedural requirement for instituting such law suit in court in Nigeria should the parties refuse to accede to our request to them on your behalf therein. You are entitled to damages as compensation. Let us know if you have receipts for payments issued by hospitals and other expenses incurred so far and the exact amount you have estimated as adequate compensation.
