LegaMart Terms and Conditions
- Introduction
This Terms and Conditions Agreement (“Agreement”) is entered into by and between Legal Market Solutions Ltd (“LegaMart”, “we”, “us”, or “our”) and any individual or entity (“User”, “you”) accessing or using the LegaMart platform (the “Platform”). By accessing or using the Platform, you agree to be bound by the terms and conditions set forth herein. If you do not agree with any provision of this Agreement, you must refrain from using the Platform. - Definitions
For the purposes of this Agreement:
(a) “Lawyers” shall include licensed legal practitioners, legal experts, fresh graduates, immigration advisers, corporate counsels, intellectual property attorneys, arbitrators, and notaries.
(b) “Legal Service Providers” means all individuals or entities offering legal services through the Platform.
(c) “Clients” (or “Applicants”) refers to individuals or entities seeking legal services via the Platform.
(d) “Subscription Package” denotes the tiered service plan through which Users obtain access to the Platform.
(e) “Platform” means the online system operated by LegaMart, which facilitates connections between Clients and Legal Service Providers. - Access and Use of the Platform
Access to the Platform is available on a subscription basis. All Users, including Lawyers, legal experts, and fresh graduates, shall maintain a professional standard of conduct equivalent to that expected of experienced legal practitioners. Users are required to ensure that all information provided in their profiles and communications is accurate, current, and complete. Any misrepresentation or failure to update such information, particularly regarding license validation, may expose the Lawyer to disciplinary or criminal sanctions in certain jurisdictions and may result in suspension or termination of access to the Platform. - Subscription and Payment Terms
(a) Subscription Access:
Lawyers, legal experts, and fresh graduates gain access to the Platform by purchasing a Subscription Package. Access is conditioned upon the timely payment of the applicable subscription fee.
(b) Automatic Upgrade:
If a User exceeds the limitations imposed by their current Subscription Package, the Platform shall automatically upgrade the User to the next higher subscription tier for the remainder of the subscription term.
(c) Modification of Subscription:
Users may elect to upgrade or downgrade their Subscription Package by providing no less than twenty-eight (28) days’ written notice prior to the annual renewal date.
(d) Client Payments and Lawyer-Client Privilege:
The Platform does not deduct any fees, commissions, or other charges from payments made by Clients to Legal Service Providers. Furthermore, the Platform shall not interfere with, or otherwise compromise, the lawyer-client privilege as recognized under applicable law. - Professional Responsibilities and Conduct
All Lawyers, legal experts, and fresh graduates are required to maintain the same level of professionalism and ethical conduct as experienced legal practitioners. This duty includes, but is not limited to, timely and effective communication with Clients, adherence to conflict-of-interest guidelines, and the safeguarding of all confidential information in accordance with statutory and professional standards. Users must ensure that their profiles, including details regarding license validation, are fully updated. Any failure to do so may lead to serious legal consequences, including criminal offences in certain jurisdictions, for which the individual Lawyer shall be solely responsible. - Client Engagement and Confidentiality
Clients may register on the Platform and engage with Legal Service Providers by detailing their legal issues and reviewing service proposals. Upon acceptance of a service offer, the Client shall remit payment in accordance with the terms of their Subscription Package. LegaMart recognizes and upholds the sanctity of the lawyer-client privilege; accordingly, all communications and exchanges between Lawyers and Clients shall remain confidential, and the Platform shall not intrude upon this relationship. - Due Diligence and Know Your Client (KYC) Responsibilities
(a) The final KYC and due diligence for Clients, including verifying the authenticity and validity of any documentation provided, shall be the sole responsibility of the Lawyers. LegaMart shall have no liability for the accuracy, validity, or reliability of any Client documentation.
(b) Lawyers are strongly encouraged to conduct comprehensive due diligence on other Lawyers, including verifying credentials, professional history, and compliance with applicable professional standards, prior to accepting or referring any case.
(c) Any failure by a Lawyer to perform the necessary due diligence shall not constitute a breach of this Agreement on the part of LegaMart, and any resulting liability shall rest solely with the Lawyer. - No Liability for Misconduct or Misrepresentation
LegaMart shall not be held liable for any misconduct or misrepresentation by Lawyers. Each Lawyer is solely responsible for maintaining an accurate and up-to-date profile, including the validation of their licenses. In the event that a Lawyer’s misrepresentation or failure to update such information results in any legal, civil, or criminal consequences, such liability shall rest exclusively with the Lawyer. LegaMart expressly disclaims any responsibility for any loss, damage, or legal repercussions arising from the misconduct or misrepresentation of a Lawyer. - Dispute Resolution and Termination
(a) Dispute Resolution:
Any dispute arising out of or in connection with this Agreement shall be resolved initially through mediation and, if necessary, by binding arbitration, in accordance with the laws of England and Wales.
(b) Termination:
Either party may terminate this Agreement upon providing the other party with written notice in accordance with the notice provisions set forth herein. Termination of access to the Platform shall not affect any obligations incurred prior to termination, which shall survive accordingly. - Amendments
LegaMart reserves the right to amend or update this Agreement at any time. Material changes will be communicated to Users via email or through a notice on the Platform. Continued use of the Platform following any such modifications shall constitute acceptance of the updated terms. - Miscellaneous
(a) Entire Agreement:
This Agreement constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior agreements, understandings, or representations, whether oral or written.
(b) Severability:
If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
(c) Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts therein.
By accessing and using the LegaMart Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
